MOBILE, AL (BuzzReport) – A legal challenge to a Mobile City Council candidate’s residency has taken a critical turn, with the city’s top election official formally requesting the court dismiss the lawsuit, citing a lack of authority in her office to determine candidate qualifications.

On Wednesday, Lisa Lambert, the Chief Election Officer (CEO) for Mobile’s municipal elections and the City Clerk, filed a comprehensive response to the suit initiated by District 2 candidate Reginald Hill. Hill’s lawsuit seeks to challenge the residency of fellow District 2 candidate, Dr. Samantha Ingram.

In her motion, Lambert asserts that the CEO’s role in the election process is strictly ministerial, not judicial. She argues that her office “has no authority to determine the qualifications of any candidate or to remove them from the ballot.” Instead, Lambert states, the CEO’s duties are limited to “receive the candidate statements of qualification and to ensure they are properly placed on the ballot.”

Furthermore, Lambert’s response highlights a significant procedural omission: Dr. Samantha Ingram, the candidate whose residency is being challenged by Hill, is not named as a party in the lawsuit. Lambert contends that Ingram is an “indispensable party,” meaning any judgment rendered in the case would directly and irrevocably impact her legal rights and candidacy without her having the opportunity to participate or defend herself in court. “Any judgment in this matter will directly impact her legal rights and candidacy,” the response states.

Given the tight electoral timeline, Lambert has also requested that an expedited hearing be scheduled. This urgent plea is aimed at “avoid[ing] irreparable disruption to the election process,” as the city gears up for its municipal election on Tuesday, August 26.

The suit’s dismissal, if granted, would represent a significant setback for Hill’s challenge, effectively shifting the burden of proving a candidate’s disqualification from the election official’s office to a different legal avenue, or potentially nullifying the challenge entirely if no other action is taken. The court’s decision on Lambert’s motion will be crucial in determining the path forward for the District 2 race.
