MURPHY, NC – A 56-year-old Cherokee County detention officer was fatally shot by an inmate during a medical transport in Murphy, North Carolina, leading to a brief escape and subsequent capture of the suspect.

Francisco Paul Flattes, an African American detention officer with the Cherokee County Sheriff’s Office, was killed by inmate Kelvin Simmons, 48, Officer Flattes had been escorting Simmons to a nearby orthopedic clinic for medical treatment when the incident occurred.

According to initial reports, a physical altercation broke out between Flattes and Simmons. During the struggle, Simmons reportedly seized Flattes’ firearm and fatally shot him.

Following the shooting, Simmons immediately fled the scene, stealing a car that had just pulled into the parking lot. He was last seen heading east on U.S. Route 64. Authorities in Clay County were quickly alerted, and deputies in neighboring Macon County located the stolen vehicle. After a short pursuit and standoff, Simmons was taken into custody without further injuries. One other officer involved in the response sustained unrelated injuries and is currently recovering.

Sheriff Dustin Smith confirmed that Kelvin Simmons will face a first-degree murder charge in connection with Officer Flattes’ death. Simmons was already in custody for bank robbery and had previously escaped in October 2024.

Officer Flattes had served with the Cherokee County Sheriff’s Office for four years. He is remembered by colleagues and the community as a brave and caring officer. His wife, who also works at the detention center, and his family are profoundly grieving his sudden and tragic loss.

The Cherokee County Sheriff’s Office and the local community are providing extensive support to Officer Flattes’ family during this difficult time, mourning the loss of a dedicated public servant.
