Mobile, AL (BuzzReport) — The first defendant charged in the killing of a 9-year-old Mobile girl is set to go on trial this week.

Prosecutors say gunfire erupted from the street along Rhett Drive in December 2023, sending bullets into a home where 9-year-old Cailee Knight was asleep on a couch. She was struck and killed. Investigators allege the shooting was not intended for the child, but rather targeted her older brother.

Darius Janoski Lucky Jr., 20, of Mobile, is the first of five defendants to face trial in connection with the case. He is charged with capital murder. Prosecutors allege Lucky was one of at least two individuals who fired multiple rounds into the residence during the incident.

Although the charge carries the possibility of the death penalty, the Mobile County District Attorney’s Office has opted not to pursue it. If convicted of the top charge, Lucky would face a mandatory sentence of life in prison without the possibility of parole.

Mobile County District Attorney Keith Blackwood is expected to personally prosecute the case. The decision not to seek the death penalty is tied in part to legal challenges surrounding the doctrine of transferred intent — a legal principle that applies when a person intends to kill one individual but unintentionally causes the death of another. Prosecutors have indicated that existing legal precedent makes pursuing a death sentence in such circumstances more difficult.

According to testimony presented by a Mobile police detective during a hearing following Lucky’s arrest, five individuals allegedly went to the home on December 5, 2023. Investigators believe the group was seeking retaliation after the victim’s older brother was accused of stealing a firearm from co-defendant Tyrone Williams days earlier.

Defense attorneys have not publicly detailed their strategy but have suggested the prosecution’s case relies heavily on testimony from co-defendants, raising potential questions about credibility and possible incentives for cooperation.

Jury selection in the trial is scheduled to begin Tuesday, with proceedings expected to continue into next week. The case is anticipated to draw close attention as it unfolds, given the tragic circumstances surrounding the death of a young child and the number of individuals charged.
