Tallahassee, FL (BuzzReport) — Tallahassee Memorial Healthcare has formally dismissed its civil lawsuit against a patient who remained in the hospital following a discharge order, bringing the legal dispute to a definitive end.

According to court records, the healthcare system filed a Notice of Voluntary Dismissal with Prejudice on March 16. The designation “with prejudice” means the case is permanently closed and cannot be refiled in the future.

The lawsuit stemmed from an incident in which the patient continued to occupy a hospital bed after a formal discharge order was issued on October 6, 2025. Legal filings indicate hospital staff made multiple attempts to assist the patient in completing the discharge process and leaving the facility safely.

On November 24, Tallahassee Memorial Healthcare issued a written notice instructing the patient to vacate the premises and предупреждение that legal action would follow if the patient refused. Despite those efforts, records show the patient declined to leave the hospital bed.

In its complaint, the hospital cited operational concerns, stating the patient’s continued occupancy impacted the availability of limited inpatient beds needed for individuals requiring acute medical care.

A motion hearing in the case had been scheduled for Monday, March 30, at 10:30 a.m. However, following the dismissal, the hearing has been canceled, according to the Leon County Clerk of Courts.

No additional details about the patient or the circumstances leading to the prolonged stay have been released.
